ALF Lawyers will assist you in understanding your rights with respect to parenting orders, financial agreements, superannuation splits, property settlements and can assist with any necessary applications to the Family Court.

Parenting Plans & Parenting Orders

It is important for parents to agree on parenting arrangements by consent wherever possible, rather than the courts having to intervene. Not only is this a quicker and less drawn out process, it’s also potentially a lot less stressful and difficult for your family and your children.
Some parents prefer an informal verbal arrangement, whilst others prefer a more formal agreement such as Consent Orders.

Divorce Applications

Seeking a divorce is never easy, and yet the fact remains that over 10,000 marriages in Queensland end in divorce every year. If you are facing the breakdown and end of your marriage, it’s important that you have a strong legal team on your side to ensure that you are supported when you need it the most.

Where you have shared assets with your partner and are seeking an equitable split of these assets, it’s simply vital that your legal team has the experience and expertise to assist you.

Wills and Estate Planning

Estate Planning is essential as it allows you to appoint a trusted person as the Executor of Your Estate who will distribute remaining assets in accordance to your Will and also act as a guardian for any minor children.

Estate planning is not just about entering into a valid Will. It may also require you considering your superannuation and whether or not you have a binding nomination, a non-lapsing beneficiary nominated or otherwise. When you attend with A.L.F. Lawyers, we also suggest that at this time you make inquiries with your superannuation fund to determine their requirements regarding your benefits.

Estate planning also means you and/or we should consider any Trust Deeds, structures of companies, partnerships and businesses you may be a part of. Oftentimes these documents govern succession matters and may not reflect the same wishes as your Will.

Your Estate Plan and your Will should be reviewed after any major change in your life to ensure they remain current and viable. In addition you should review your Will every 5 years to validate that it is still current. Your Will may be affected by changes in your investments, status of personal home, financial situation, marital situation, separation, Divorce, entering into a defacto relationship, death of a relative, birth of a child or a grandson, adoption, stepchildren etc. You may also want to update your will if your personal situation changes with beneficiaries.

Probate/Letters of Administration

A.L.F. Lawyers understands the pain and grief associated with losing a loved one. They will ensure that processes run smoothly during a period of grief.

When a loved one passes, an executer will usually require assistance in dealing with probate applications.

A Grant of Probate is necessary in order for the Executor to dispose of assets and or debts.

Probate is an application to the Supreme Court of Queensland to authenticate the terms of a will and to give authority to the executors to deal with the Estate. When an individual die’s, someone will be left responsible for handling the estate. Where a will exists, this person is referred to as the Executor of the Will.

Power of Attorney and Enduring Power of Attorney

A Power of Attorney is a legal document which gives authority to another person (known as the attorney) to make certain financial decisions and sign certain documents on behalf of the donor.

There are several kinds of powers of attorney; they share the same main features but are used for different purposes. The powers may be limited to just a short period of time or to just certain affairs or they may be enduring or irrevocable and remain in effect after the appointer lacks mental capacity. The main advantage of a power of attorney is that the donor’s affairs will be managed by the attorney if the donor is unable to administer them personally, such as if the donor goes overseas, becomes ill or becomes mentally incapacitated.

There are certain drafting and execution requirements for an Enduring Power of Attorney to be valid, so quality and experienced advice from a Probate Lawyer or Estate Solicitor is crucial if you intend to grant a power of attorney or are asked to act as an attorney.
